A hotly contested divorce is one of the most stressful situations a
person can encounter during his or her lifetime. The parties may fight
over everything and may find it difficult to imagine that the situation

What happens in a contested divorce

Contested divorces generally center on property or children. One great disadvantage of this situation is that a judge can determine the temporary arrangements for kids, housing, and support for as long as the divorce takes. And it can sometimes take a long time. There is a discovery period, where each party requires the other to produce relevant documents about income and assets. If custody is at issue, there may be a social study, drug tests or an amicus attorney appointed to evaluate the situation. If the parties cannot agree to There may be mediation. If the parties are unable to agree, there will be a trial. If one party is accusing the other of fault, or causing the divorce, there can be an investigation which could result in an unequal property division, or custody and visitation limitations. The whole process can last from two months to seven months or more, requiring the parties to live according to the temporary orders until the divorce decree is finalized.

Alternatives to contested divorce

My law office encourages clients to use alternate methods to resolve
disputes over property and children in a divorce. Mediation is a less
formal meeting with an unbiased third party to resolve property
distribution, custody, and any other issues relative to the divorce.
Mediation and collaborative family law techniques give the parties
much more control of the process while settling their differences in a
much less confrontational way. Such approaches encourage the
parties to agree on the terms of divorce. Divorcing or separating
people are only required to agree that they will try to resolve disputes
without going to trial.
