Emergency and temporary orders
The law offers people experiencing domestic violence or assault three
avenues: emergency orders, protective orders, and restraining orders.
Emergency orders can be imposed by a family law judge. Temporary
restraining orders, or ex-parte orders, are common in divorce actions.
They offer immediate protection against an abuser. They also
maintain the status quo, preventing the other party from emptying
bank accounts, purchasing or selling assets, or running up credit card
bills.
Permanent protective orders
A permanent protective order prevents future assaults, making it
illegal for the abuser to be near the other party. Violations of this
order can be criminal behavior, with the violator subject to arrest. In
order to obtain a permanent protective order, victims must attend a
hearing at which the abuser is present. These orders are awarded for
up to two years, and can be renewed.
