The law is complicated. If you’re not a lawyer you probably have no business acting like one. A solid case can quickly unravel without the help of a trained and experienced family law attorney. Failing to hire an attorney in a divorce can result in otherwise avoidable pitfalls. Even experienced lawyers typically do not represent themselves in divorce court.

Divorce lawyers vary quite a bit in their approach to divorce, as well as in their demeanor. Some may take more of an adversarial approach or specialize in contested divorces where there’s lots of disagreement about who gets what. Others may want to approach divorce in a more collaborative way, keeping the peace as much as possible.

Divorce is the most emotionally charged area of law. Emotions and lack of knowledge get in the way of making important decisions in family law cases. A family law attorney is able to look at your case in a different way and give you options that you do not know about, options that you can’t find on the internet or in a book. An experienced family law attorney knows how to separate the emotion from the law and the facts of the case. He knows the court rules, procedures and knows how Judges rule on different issues. This knowledge is learned from the experience of being in court on a day to day basis. My law practice is exclusively limited to family law. You need an attorney to represent your interests that has the experience that is necessary for you to get the results you want for the lowest cost as possible. I provide honest straight-forward legal advice about your case and let you know what you need to know, not what you want to hear. This saves you time, emotional distress and money.

Having an attorney does not mean that your case will become more complicated, actually, it usually means the exact opposite. I know how to bind a party into an irrevocable agreement to all of the terms in a divorce at the beginning of the case, if the parties agree. If the parties are not able to agree I can get a hearing within thirty days to get the parties together to try to come to an agreement. I can make this written agreement binding on each party. If you and your spouse come up with an agreement without an attorney, your agreement may not be accepted by the family law judge. I know how to get an agreement between the parties without having a Judge’s approval. To start a divorce contact my office for a free initial case evaluation.

If you do not have an attorney you are held to the same standard as an attorney in knowing the Texas Rules of Evidence, the Texas Rules of Civil Procedure and the Texas Family Code. You make think you can get evidence into court only to learn that you are not allowed to use that type of evidence, after it is too late. If you are not an attorney, you may also struggle with deadlines and protocol for properly filling out and filing certain legal documents. One late or incorrect filing could derail your case, delay a given legal procedure or worse– you may have the case thrown out altogether (and not in your favor). It’s always better to avoid legal problems rather than try to fix them later. An experienced family law attorney know how to negotiate settlements and can resolve cases using their knowledge of the court system for your benefit. The knowledge of an attorney can prevent you from trying to obtain a result that is unattainable.

The first step is to retain and attorney and pay a retainer. A retainer is money that is paid for future time and expenses of the attorney and his staff. A lot of my clients are paid salaries or work by the hour. They are on a budget. One of the options that I offer is to be able to pay the retainer with a payment plan. I can help people who have budgets and don’t have a lot of assets. I know what steps I can take to help the case resolve sooner than later. Clients want to know how long it’s going to take, what’s it going to cost, and what results I can get. I work hard to get good client reviews and I have happy clients who rely on my experience.

I can give people an idea of whether they are going to be successful or not, whether they should spend money on something or not, and what range of cost it’s going to be. For 98% of my clients, a divorce settlement can be reached. If it goes to trial, the cost is a lot higher and we can’t do payment plans for trial. I make it affordable for people to hire an experienced attorney to represent your interests. We have payment plans in house and via the internet with a company that allows you to borrow money easily for family law cases.

What Is Involved In A Child Custody Evaluation?

There are many things that go along with a child custody evaluation. When I ask child custody questions, I ask about alcohol use, illegal drug use, mental illnesses, domestic violence, CPS cases, prior criminal charges, arrests, how the children are doing in school, living conditions, boyfriend or girlfriend problems, job stability and many other areas of questions. I try to learn as much as possible to make sure the children are in a safe environment. The goal is to fight for what is in the best interest of the children. The most important thing we do in family law is finding solutions to help make our clients and their children be safe. I have a very organized approach to learning about all of the things that are important in making a determination of who should get primary custody of the children. I can get injunctions to protect the children and injunction to protect you. Getting an opinion of an experienced family law attorney is important. Learn what your options are before you act
